Position Overview
We are seeking a PAGA Litigation Attorney with direct Private Attorneys General Act (PAGA) experience to join our team. The ideal candidate will be responsible for handling PAGA and employment law matters from case evaluation through trial, collaborating closely with paralegals and case managers, and strategically litigating against employers, defense counsel, and insurance carriers.
Key Responsibilities
- Case Assessment: Identify employment cases that are best suited for litigation, with a strong focus on PAGA claims and wage and hour violations, including unpaid wages, meal and rest break violations, overtime violations, off-the-clock work, and other California Labor Code violations.
- Litigation: Draft pleadings, discovery requests/responses, motions, and briefs. Represent clients in depositions, hearings, mediations, arbitrations, and trials related to employment and PAGA matters.
- PAGA Compliance: Prepare and manage LWDA notices, PAGA filings, and statutory requirements, while developing litigation strategies for representative PAGA actions.
- Negotiation: Engage in settlement negotiations with defense counsel and opposing parties to secure favorable outcomes for clients.
- Client Communication: Act as a secondary point of contact for clients who require attorney communication, while case managers remain the primary client liaison.
- Collaboration: Work closely with paralegals, case managers, and support staff to move cases forward efficiently and ensure strong case development.
- Compliance: Ensure all case activity complies with court deadlines, ethical standards, and firm procedures.
Qualifications
- Active license to practice law in California, in good standing.
- Minimum of 1 year of employment litigation experience with direct PAGA experience required.
- Strong understanding of California Labor Code violations and Private Attorneys General Act (PAGA) procedures, including LWDA notice requirements.
- Strong legal research, writing, and oral advocacy skills.
