Job Description
Creditor Rights Attorney Role based in Columbia for a growing firm with the opportunity to work remote while maintaining the ability to attend court. Represent lenders, financial institutions, and businesses in recovering debt, enforcing security interests, and navigating bankruptcy proceedings. The ability to handle high-volume litigation, including foreclosures, replevin actions, and collections, while ensuring compliance with state and federal laws.
Key Responsibilities
- Litigation & Enforcement: Manage a high volume of cases, appearing in court for hearings, trials, and depositions.
- Legal Documentation: Draft, review, and file motions, pleadings, and discovery requests.
- Bankruptcy Proceedings: Represent creditors in bankruptcy cases to maximize recovery.
- Negotiation: Negotiate settlements and workout agreements with debtors or their legal counsel.
- Compliance & Risk: Advise clients on legal options and mitigate risk regarding distressed loans.
Qualifications
- Education: Juris Doctorate (JD) from an accredited law school and active South Carolina license.
- Experience: 3-5+ years in commercial litigation, creditors' rights, or bankruptcy.
- Skills: Strong advocacy, negotiation, and case management skills, with proficiency in FDCPA, RESPA, and TILA regulations
