Job Overview

Macy’s Senior Counsel, Litigation is a member of the Macy’s existing in-house litigation team located in St. Louis. The St. Louis team handles Macy’s nationwide, uninsured litigation docket. This role entails actively litigating all aspects of lawsuits against the company from initial response to appeal. Please note this is not a position that monitors cases – the team actually litigates matters across the country. The ideal candidate must have substantial employment experience, including serving as second chair in trials. First chair experience is a plus but not required. Additionally, the successful candidate should be familiar with complex and class action litigation. Strong written and verbal communication skills are a prerequisite for this position. Candidates must submit two or more substantive writing samples for review before they will be considered further.

What You Will Do

  • Analyze complex legal and factual issues and write persuasively to convince the audience.
  • Litigate a range of employment and complex litigation matters independently and with minimal supervision in multiple jurisdictions, on behalf of the Company from investigation to appeal, including but not limited to, research; writing briefs/motions; interviewing witnesses; investigations; drafting /responding to discovery; taking/defending depositions; mediating; negotiating; conducting arbitrations and trials as first or second chair; communicating with the client, opposing party, courts, and arbitrators. This position does not monitor cases but actively litigates across the country.
  • Convey legal advice and opinions effectively to all levels of the organization and serve as an advocate in court and arbitration.
  • Stay abreast of the use of new technologies, systems, and processes (e.g., matter management system, billing system, legal research tools, databases, human resources information systems, etc.).
  • Supervise, develop, and train less-experienced staff as required.
  • Continuously learn and expand/adapt practice areas to meet the ever-changing legal landscape in multiple jurisdictions and the needs of the company.
  • Participate in interdepartmental conferences, committees, and meetings.
  • Foster an environment of acceptance and respect that strengthens relationships, and ensures authentic connections with colleagues, customers, and communities.
  • Perform other duties as assigned.

Skills You Will Need

Litigation Experience: 10-15 years of active litigation experience required, including second chair trial experience. Arbitration experience a plus as is first chair trial experience. Experience in employment, class action, and other commercial matters also a plus.

Writing Skills: Expert legal writing skills, with a submission of two or more writing samples demonstrating skill level required in advance of interview.

Autonomous and Team Player: Ability to work autonomously and as part of a team depending on departmental needs.

Communication Skills: Strong verbal and written communication and interpersonal skills, with the ability to work collaboratively with both the litigation team and clients.

Client Service: Excellent client service skills.

Organizational Skills: Strong organizational and time management skills required to prioritize assignments and multitask while handling a large nationwide docket.

Technological Proficiency: Familiarity with and willingness to learn and use new technologies, systems, and processes.

Analytical Skills: Ability to analyze complex legal issues independently and under minimal supervision.

Who You Are

  • Candidates with a J.D. from an accredited law school and who are licensed to practice law in at least one state are encouraged to apply. Must be willing to seek admission to the Missouri bar.
  • Regularly required to sit, talk, hear; use hands/fingers to touch, handle, and feel. Occasionally required to move about the workplace and reach with hands and arms. Requires close vision.
  • Able to work a flexible schedule based on department and company needs, including nights and weekends.
  • Significant nationwide travel required unless able to use virtual tools where allowed by the court and/or arbitrator. Travel/virtual tools are required for approximately 25% of work duties and can involve any state in which Macy’s operates.
  • While the position will allow for some remote work (in the St. Louis area) after the first six months, the successful candidate will be required to be in-office for a significant portion of the first six months for training.
