The basic requirements of a woman to serve as a surrogate are:

- Responsible
- In good physical health

In Texas, there is a judicial process for validating the Gestational Contract (the contract between the intended parents and the surrogate). Included within the various requirements for having a Gestational Contract validated by a Texas court is that the intended parents must be married and the surrogate must have previously carried a child to term.
